Student Bill of Rights
The Office of Title IX at Elizabeth City State University is committed to providing options, support, and assistance to victims/survivors of sexual assault, domestic violence, dating violence, and/or stalking to ensure that they can continue to participate in college/university-wide and campus programs, activities, and employment.
All students have the right to:
- Be treated with respect and dignity, regardless of gender, gender identity, race, age, income level, physical abilities, cognitive abilities, or sexual, medical, and mental health history.
- Have disclosures of domestic violence, dating violence, stalking, and sexual assault or harassment treated seriously.
- Have timely access to emergency and crisis counseling services.
- Be informed of legal rights and available resources.
- Treat Complainants and Respondents equitably.
- Receive supportive measures for the Complainant and Respondent.
- Be informed of appropriate follow-up treatment, medical testing, and counseling.
- Be free from any suggestion that the victim/survivor is at fault when these crimes and violations are committed or should have acted in a different manner to avoid such a crime.
- Describe the incident to as few individuals as practicable and not to be required to unnecessarily repeat a description of the incident.
- Have the university conduct a prompt and thorough investigation of the allegation, preserving the privacy of the survivor to the extent possible within the requirements of Title IX.
- Be notified of options for and assistance with changing academic and/or living situations if so requested and if such changes are reasonably available.
- Participate in a process that is fair, impartial, and provides adequate notice and a meaningful opportunity to be heard.
- Presume the Respondent is not responsible for the alleged conduct until a determination regarding responsibility is made at the conclusion of the complaint resolution process.
- Be accompanied by an advisor of choice who may assist and advise a reporting individual, accused, or Respondent throughout the judicial or conduct process.
- Have a support person present during campus disciplinary proceedings.
- Be informed of the outcome of any disciplinary proceedings.
- Make a report to local law enforcement and/or state police.
